Article 1 - Organizer of the game

BABOLAT VS, SAS with a capital of 1 275 000 €, registered at the Chamber of Commerce of Lyon under the number B 552 131 401, whose head office is located at 33 Quai Paul Sedallian 69009 Lyon, France, organizes a contest game with newsletter subscription obligation entitled " Win our RH12 Pure Wimbledon Bag".
The contest game will be held from June 27th 2022 at noon (12:00 am) (French time) to July 11th, 2022 at noon (12:00 am) , on Instagram.
Participation in this Contest game implies acceptance of the terms & conditions of the game which are available at: https://cloud.news.babolat.com/contestbag

Instagram do not organize or support the Game. The personal data collected during the Game are only aimed to BABOLAT, the organizer of the Game. Participants acknowledge that Instagram cannot be held responsible for any problems related to the Game.

Article 2 - Participation in the contest game

The game contest is open to all participants of legal age. (i.e. over 18) in any country and excluding anyone directly or indirectly involved in the Game’s design, implementation or management (BABOLAT VS employees and/or any of its partners), as well as members of their family and those of their spouse.
To participate in the game contest and try to win one of the 22 Rafa signed posters, each participant must respect the following conditions:

- Have an Instagram and a valid Internet connection
- Read and accept the terms and conditions of the contest game unconditionally
- Fill out the participation form,
- Subscribe to the Babolat newsletters on the form.

Each participant can subscribe only once. BABOLAT VS reserves the right to disqualify, at any time and without warning, participants who submit more than one participation or who undertake any type of fraudulent maneuver or action aimed at circumventing the provisions of these terms and conditions.
The countries of residence of the participant are not limited excepted to countries subject to international economic sanctions.

Article 3 - Designation of the winning participant and delivery of the prize

1 (one) winner (only) will be determined on the July 11th, 2022 by a random draw, conducted by BABOLAT VS. If there is a doubt concerning the accuracy of the information provided by the winner, BABOLAT VS reserves the right to request all supporting documents in order to definitively validate the awarding of the prize.

The winner will be informed of his/her victory in the competition by an e-mail sent to the address indicated on the coupon. The winner must confirm that he/she accepts this winning prize and the conditions of attribution by replying to the confirmation e-mail within 8 days of its receipt and by providing his/her complete contact information (first and last name, e-mail address and postal address). Failure to confirm acceptance of the winning prize and to provide the requested information within the aforementioned time period will result in the loss of the right to claim the winning prize and its reallocation to a new winner via a new random draw.
BABOLAT cannot be held responsible if the winner gives a wrong address or for any problem during the delivery of the prize.

The prize cannot be the source of any requests for compensation, nor of any special rights or advantages other than those relative to the awarding of the prize as set forth herein (particularly for the equivalent value in cash or for any other goods or services of any kind whatsoever).
The winner will not be entitled to any exchange or consideration in cash or of any kind whatsoever.

Article 4 - The winner's prize

The game contest with the Babolat newsletter subscription obligation includes only 1 prize:
-1 RH12 Pure Wimbledon Bag. Value: 139,95€ / £119,99 (VAT included).
If BABOLAT VS is unable to deliver the prize described in this article, BABOLAT VS reserves the right to replace this prize with another prize of equivalent value (€139,95 / £119,99 including tax).

Article 5: Registration of the official Terms & Conditions

The Terms & Conditions will be accessible throughout the duration of the Game at https://cloud.news.babolat.com/contestbag
The Terms & Conditions may be modified at any time by BABOLAT VS and will be published under its amended form as indicated above. The amended version of the Terms & Conditions will enter into effect and will be considered as accepted by the participants as soon as they are published online.

Article 6 - Responsibilities

BABOLAT cannot be held responsible if, in the event of force majeure, circumstances beyond the organizer’s control or any other circumstances that require the game to be changed, postponed, shortened or cancelled. Furthermore, BABOLAT reserves the right to extend the duration of the game and/or to change any dates announced.

BABOLAT may cancel all or part of the game if it appears that there have been any types of fraud or use of any type of artificial means (and/or attempts to do so), notably in terms of IT, within the framework of the Game. Should this be the case, the organizer reserves the right to award the prize of any such person (having carried out or attempted to carry out fraudulent or artificial means within the framework of the game) to someone else.

BABOLAT cannot be held responsible if, following any type of fraud (and/or attempted fraud) or use of artificial means (and/or attempted use thereof), the draw must be changed, postponed or cancelled, or the length of the game changed.

Participation in the game entails full knowledge and unconditional acceptance of the inherent characteristics of the Internet, particularly in terms of the technical performance, response time for consulting, questioning or transferring information, risks of interruption, and more generally, the inherent risks involved in any connection and/or transmission via the Internet, the absence of protection of certain data against potential misappropriation and/or risks of contamination by potential viruses circulating on the network. It is the responsibility of each participant to take all appropriate measures to protect his or her own data and/or software stored on his or her computer equipment against any attack. The connection of any person to the internet, in particular to Instagram, and participation is made under his sole and entire responsibility.

BABOLAT declines all responsibility in the event of an incident resulting in the disconnection of participants, poor use or any type of incident relating to the Internet access, the telephone line or any other technical connection, in particular while signing up for the game or confirming acceptance of prizes. BABOLAT cannot be held responsible for any problems regarding the delivery or loss of data which constitute a risk that is inherent to the Internet.

Article 7 - Agreement of proof

Except in the case of obvious error, it is agreed that the information provided by the participant's form will prevail as official proof in any dispute.

Article 8 - Personal data

Personal data of the winner will be collected by BABOLAT in compliance with the French law n°78-17 dated January 6, 1978 and the General Data Protection Regulation (GDPR) n° 2016/679 of European Union dated April 27, 2016.
Participants are informed that personal data is collected for the purposes of receiving the Babolat Newsletter.
The data is destined for BABOLAT in order to manage the Game and for the purposes outlined above, and to contact the winner for the registration prize.

Article 9 - Intellectual Property

All trademarks, logos, texts, images and other distinctive signs reproduced on the elements relating to the Game are the exclusive property of BABOLAT and are protected as such by the provisions of the French intellectual property code. Their unauthorized reproduction constitutes an infringement liable to penal sanctions.

Article 10 – Applicable laws / Disputes / Jurisdiction

This official set of Terms & Conditions is subject to French law.
BABOLAT has absolute authority to rule in favor of or against any claims relating to the Game and the interpretation or application of the official Terms & Conditions.
Unless the public authorities decide otherwise, any disputes not resolved in a friendly manner will be handled by the courts of Lyon.
